Prosecution moves to impeach its key witness

SHAH ALAM (July 2, 2007): She was the prosecution's key witness, but what L/Cpl Rohaniza Roslan told the court today has landed her in trouble with the prosecutors. The court adjourned after lunch today to allow the prosecution time to prepare impeachment proceedings against the policewoman, who is the girlfriend of murder accused Chief Insp Azilah Hadri. After lunch, prosecution team leader DPP Tun Abdul Majid Tun Hamzah asked for a postponement, saying they had detected four contradictions in Rohaniza's testimony and her 16-page cautioned statement. The contradictions were not detailed in court.
Tun Abdul Majid: My lord, we seek a postponement to continue with the impeachment tomorrow as we have to go through the 16-page cautioned statement of the witness. So far, we have detected four contradictions in seven of the pages and have to check the remaining nine pages.
Justice Mohd Zaki Md Yasin: Will it take long to go thorough it?

Mohd Zaki said he will instruct the senior assistant registrar to check whether the other cases can be moved to enable this case to continue without interruption.
As for July 11 and 13 and the last week for the month, Mohd Zaki said the court would have to check if this case can be slotted in while the other days are subject to whether any other cases had been fixed and if they could be moved to a later date.
Mohd Zaki said some of the other cases were 2002 cases and some involved civil servants.
Tun Abdul Majid, when asked by Mohd Zaki if he would be free, replied that three of his team members would not be available in the second week of August because they had to attend classes for a masters degree programme.

'I last saw Altantuya being driven away from Bukit Aman'
SHAH ALAM (July 2, 2007): The girlfriend of murder accused Chief Insp Azilah Hadri testified today she last saw Altantuya Shaariibuu being driven away from the Bukit Aman federal police headquarters in a green Vitara driven by a man wearing a green cap on Oct 19.
L/Cpl Rohaniza Roslan, 29, said she saw Azilah and Altantuya, whom she referred to as a "Chinese woman" walking towards the Vitara in Bukit Aman.
She said when Azilah opened the front passenger door, she saw Altantuya sitting inside. "I saw the Vitara leaving Bukit Aman. Azilah was with me," Rohaniza said.
She had informed the court earlier she told Azilah she wanted to meet her friends later that day. She said Azilah told her to drive her red Proton Wira Aeroback to meet her friends.
"I saw Azilah walking into the UTK (Special Action Squad) office," said Rohaniza. She said she drove her car to her barrack in Petaling Jaya.
Asked by DPP Noorin Badaruddin whether she had contacted Azilah later, Rohaniza said she was not sure whether she had called him or Azilah called her, but said she asked him where he was.
Rohaniza said Azilah told her he was in his office in Bukit Aman.

When asked by Noorin whether she spoke to Azilah on her way to Putrajaya, she said she did. "I asked him why he was late and he said he went to meet a friend."
On whether she asked Azilah about the Chinese woman, she said she did not.
Rohaniza said she met Azilah again in his parents' house in Sungai Pelek, Sepang, Selangor.
"At that time his behaviour was different," she said, adding that he was quiet when he usually spoke to his family when they met.
Later on the way back to Putrajaya, she queried him on his behaviour.

A: He told me he was confused.

She said she chided him and told him to speak properly but he did not elaborate. She said she told him that she would check with the police station about the woman.
She said she later called the Travers and Brickfields police station to check whether there was any police report on a foreigner being kidnapped or raped on Oct 19.
When asked by Noorin why she said Altantuya was a foreigner, Rohaniza said it is because the "Chinese woman" did not speak Malay.
Earlier, Rohaniza continuing her testimony from last Friday (June 29) said the Vitara stopped on the highway heading to Bukit Aman from Bukit Damansara.
She said Azilah went into the Vitara but returned to her car.
She said she asked Azilah where Altantuya would be sent and he said back to her hotel.She said once they reached Bukit Aman, the Vitara headed towards the senior police officer's Mess and they followed. "The Chinese woman said in English this is not police station, these are houses," Rohaniza said. She said the car stopped at a junction and Azilah got out of the car and spoke to the man driving the Vitara. She said Azilah later came to their car and spoke to Altantuya, before both of them walked to the Vitara. Altantuya got into the Vitara which left Bukit Aman after that.

Prosecution Intends To Impeach Policewoman's Credibility
SHAH ALAM, July 2 (Bernama) -- The trial for the murder of Mongolian Altantuya Shaariibuu took an unexpected turn today after the prosecution told the court that they intended to challenge the evidence given by a key witness. Deputy Public Prosecutor (DPP) Tun Abdul Majid Tun Hamzah said the prosecution had detected more than four contradictions in the testimony of L/Cpl Rohaniza Roslan(BELOW) with that of her cautioned statement recorded under Section 112 of the Criminal Procedure Act on Nov 16 last year.
"We also need more time to prepare statements for the court and counsel," he said, requesting for a postponement to identify more contradictions in the evidence given by the 29-year-old policewoman, the seventh prosecution witness and girlfriend of accused C/Insp Azilah Hadri. Judge Datuk Mohd Zaki Md Yasin obliged but ordered for the hearing to continue tomorrow. This morning, DPP Noorin Badaruddin applied to discontinue the examination -in-chief after three hours, saying "we intend to impeach this witness." Altantuya Taken Out Of Bukit Aman By Man Wearing Green Cap, Witness Says
SHAh ALAM, July 2 (Bernama) -- Murder accused Chief Inspector Azilah Hadri's girlfriend told the High Court here Monday that the last time she saw Altantuya Shaariibuu was when the Mongolian woman was being taken away from the Bukit Aman Federal Police Headquarters in a vehicle driven by a man wearing a green cap on Oct 19 last year. Lance Corporal Rohaniza Roslan said the woman, whom she identified as Altantuya, was taken in a Suzuki Vitara four-wheel drive by Azilah's friend. She said that after the vehicle had left the Bukit Aman Police Headquarters, she saw Azilah walking towards the Special Action Squad office there. She said she had asked Azilah what had appened to Altantuya and Azilah replied that he did not know how the woman could have disappeared suddenly.
Deputy Public Prosecutor Noorin Badaruddin, who was questioning the witness, later told the court that the prosecution would impeach the witness in the afternoon.

Initially there was confusion in the court when Judge Datuk Mohd Zaki said he did not have Burmaa's evidence relating the picture in his record.
Karpal Singh told the judge that Burmaa did give the evidence but he (the judge) did not take it down.

As a result of Burmaa's evidence on the "government official", two separate heated arguments arose between Karpal and Deputy Public Prosecutor Tun Abdul Majid Tun Hamzah and also between Karpal and Azilah's counsel Hazman Ahmad.(BELOW)
Hazman had accused Karpal of coaching Burmaa to give evidence on "the government official" while Karpal had disclosed an allegation implicating Azilah (the allegation was also mentioned in Abdul Razak's affidavit to support his bail application) that Abdul Razak sought help from a DSP Musa Mohd Safri when Altantuya was causing a scene at Abdul Razak's house and that DSP Musa requested his officers to take Altantuya away.

SHAH ALAM (June 29, 2007): Altantuya Shaariibuu's cousin told the High Court here today that in August 2005, Abdul Razak Baginda and Altantuya were still having a relationship as they travelled to "Europe, France and Italy" together.
Burmaa Oyunchimeg, who is also known as Amy, 26, in reply to a question from the prosecution, said Altantuya had shown her a photograph of her with Abdul Razak and Malaysian government officials.
Later, when asked by Karpal Singh, who is holding a watching brief for Altantuya's family and the Mongolian government, Burmaa said the photograph was shown to her in Hongkong, on Altantuya's return from
Karpal: Who were the government officials in the photograph?
Burmaa: Najib Razak. I remember the name Najib Razak. I remember Razak is the same name. I asked her (Altantuya) 'are they brothers' because they have same name.
Karpal's questions were preceded and followed by objections from both the prosecution and a defence lawyer who said they were irrelevant to the case and that the answers should be expunged.
The court however later allowed Burmaa's answers to remain on record.
The drama started when DPP Manoj Kurup re-examined Burmaa, the sixth witness, on her answers to questions from Abdul Razak's lawyer Wong Kian Kheong yesterday.
Manoj said Burmaa had disagreed with Wong's suggestion that Abdul Razak sent money to Altantuya even after he had ended their relationship.
Asked why she had disagreed, Burmaa said: "I disagree because Altantuya told me there is a little misunderstanding and she will sort it out."
Q: She told you this before she left to
A: Yes.
Q: So you are saying in August 2005, their relationship was still there?

He said he wanted to ask questions on Altantuya's work, other languages she spoke and also on the goverment officials.
At this point, objections were raised, first by DPP Tun Majid Tun Hamzah and then lawyer Hazman Ahmad.
Karpal said the witness did say there were government officials in a photograph and he wanted to pursue it.
The judge said he did not have record of this and asked the witness whether she had said so.

As the Mongolian interpreter was translating what she said, Hazman objected. Tun Majid also objected, saying there was no relevence and he explained to the judge that that was not the question from Manoj.At this point, both Karpal and Tun Majid started to address the court at the same time, resulting in each telling the other to shut up.
Then Majid said Karpal should put the question through prosecution while Karpal said Tun Majid had sent a contemptuous letter. (Tun Majid had sent a letter to Karpal on the court's decisions that if he had questions, he had to go through the prosecution and not the court).
Karpal told Tun Majid not to hide and he replied that he was not hiding anything and to let him finish.
The judge then checked his own notes. At this point, Tun Majid told Karpal that he had no right to tell him to sit down.
Zaki also told Karpal the same thing.
Karpal said when he was addressing the court, Tun Majid must sit down.
Karpal then read out his notes of the proceeding pertaining to this matter.
Tun Majid said they did not record the anwer and said the reply was not the anwer to the question posed by Manoj.
"That is why I am pursuing it," said Karpal.
At this point, the witness said she had said it. Karpal then asked permission to put the questions through the court.
The judge said he must hear Karpal's questions first before allowing him to ask. "I want to know the questions first as I may not allow it."
The judge checked his notes again and then allowed the question to be asked as the witness said she had said it and that he had "missed it".

Karpal said there was evidence in the court in Abdul Razak's affdavit about ADC (Aide de Camp) of the deputy prime minister, who is 'DSP Musa'.
However, Zaki said it was in the bail application, which was not before him. Azilah's lawyer Hazman Ahmad said the statement was subjudice.
Tun Majid said they would be calling the witness (DSP Musa) and that he could question him then.
Hazman said Karpal had access to the witness and interpreter and alleged that he had been coaching the witnesses.
Karpal then protested and asked for the allegation to be withdrawn.
Hazman said Karpal should also withdraw his statement about DSP Musa.
Tun Majid then asked for the purpose of holding a watching brief. He said it is to assist the family."We are not here to turn the court into a political forum. You can go to Parliament to do it. You must have respect for the court. There must be respect," he said.
Tun Majid asked: "Why can't you have faith in the system? Let the trial go on smoothly."
Hazman said Karpal had also made an allegation about the deleted Immigration records.
Karpal again told Hazman: Withdraw the statement or face the consequences.
Hazman: Don't threaten me, this is a court of law.
The judge said he had recorded that Tun Majid and Hazman had objected.
He said he did not record the part on DSP Musa.
On the matter between Karpal and Hazman, he said he will leave it to them both and will not make any order.
He said he disallowed Karpal from further questioning the witness but said he recorded the witness's answer on the photograph.
Azilah warned Altantuya not to disturb Abdul Razak: Rohaniza
SHAH ALAM (June 29, 2007): The High Court here was told that Chief Insp Azilah Hadri, the first accused in the murder trial of Altantuya Shaariibuu, had warned the Mongolian woman not to disturb Abdul Razak Abdullah Baginda.
Azilah's girlfriend, L/Cpl Rohaniza Roslan, 29, told the courtt she heard Azilah instructing Altantuya to meet Abdul Razak personally in the political analyst's office if she had any problem and not to create a commotion in front of Abdul Razak's house.
Altantuya was also reminded by Azilah not to disturb Abdul Razak as healready had a family, Rohaniza testified.
Rohaniza, who is attached to the Federal Police Headquarters Administration Department, Bukit Aman, disclosed this in her testimony as the seventh prosecution witness during examination in chief on the 10th day of the Altantuya murder hearing.

Earlier, before relating the incident on the night of Oct 19, Rohaniza, dressed in police uniform, cried when Deputy Public Prosecutor Noreen Baharuddin asked her to identify Azilah in the dock.
"(Azilah is) the third person on the left, Your Honour," said Rohaniza, wiping tears from her eyes.
Azilah just looked down without turning to Rohaniza when she made the identification.
Rohaniza testified that about
Noreen (ABOVE) : Who was Azilah Hadri to you at that time?"
Rohaniza: Azilah was my boyfriend.
Rohaniza said she and Azilah had been friends for the past nine years and their relationship was close. Noreen subsequently asked Rohaniza to describe what transpired after the dinner in the restaurant at about

"As we were clearing up, Azilah suddenly received a call on his handphone and he went out of the office for about five minutes.
"Azilah later told me he wanted to see a friend in Damansara," she said.
She said Azilah initially did not want her to follow, but after she pleaded that she did not want to be left in the office together withAzilah's friend, the first accused later agreed to take her along.
Rohaniza said they later went to a double-storey house in a residential area in Bukit Damansara in her (Rohaniza's) car which was driven by Azilah.
Upon arrival in front of the house, Azilah stopped the car outside the perimeter fence without switching off the engine.
When asked to estimate the distance between the car and the house, Rohaniza said "the distance is similar to the distance between my (present) seat and Your Honour", she said pointing to Justice Datuk Mohd Zaki Md Yasin.
"What is the estimated distance? As a policewoman, you should know. If you can't (estimate) in metric (measurement), use feet (as measurement)," said Mohd Zaki, which drew smiles from those in the public gallery.
"Hah, what is the distance? The lawyers too (need to know)," Mohd Zaki asked Noreen.
"I too am not sure, why don't we use a ruler and make a guess?" replied the Deputy Public Prosecutor with a chuckle.
Defence counsel Wong Kian Kheong, representing Abdul Razak, chipped in, saying that the distance meant by the witness was about six to seven metres.
Continuing her testimony, Rohaniza said after the car had stopped, she saw an Indian man and a Chinese woman talking beside a car.
"Azilah then got out of the car and walked to the Indian man and spoke with him briefly. Later, he walked to a tree, I'm not sure whether he had received a call or was making a telephone call," she said.
Throughout the proceedings, Rohaniza was asked repeatedly by Noreen to give her testimony slowly and clearly, to facilitate the court and lawyers in taking down notes.
Noreen later asked Rohaniza the distance between the tree referred to by the witness and her car.
"From where Your Honour is sitting to the back door," replied Rohaniza as she pointed to the court's backdoor.
"Now I am being used (as measurement)!" said the judge, drawing laughter from those present in court.
"How far Encik Wong?" asked Noreen and the defence counsel replied "about 15 metres".
Rohaniza later told the court Azilah subsequently approached her (Rohaniza) and asked her to move over to the back seat and saw the Chinese woman walking towards her (Rohaniza's) car.
The woman then sat in the back seat on her left. However, Rohaniza did not ask who she was.
Noreen: What transpired?
Rohaniza: As we were leaving, a man wearing a green cap suddenly came from behind the car. He boarded the car and sat beside Azilah.
Noreen: Can you identify the man?
Rohaniza: No.
Noreen: What happened then?
Rohaniza: As we were about to leave, a taxi driver suddenly came to ask for taxi fare. He said that the Chinese woman had not paid her taxi fare. Azilah scolded the woman and took out money to pay the taxi driver, looked like RM50 but I don't know how many pieces.
She said Azilah then drove the car up to a junction and stopped after the man wearing the cap had asked to do so.
Rohaniza said after Azilah had stopped the car, she saw the man with the cap walking towards a Vitara car parked beside a tree.
She testified that although she could not identify the vehicle's registration number, she was certain that it was a dark green Vitara as she could see clearly because there was a street light at the junction.
Later, Rohaniza testified that the man drove the Vitara and Azilah followed in her car.
During the journey, Rohaniza said Azilah spoke in English and issued a warning and reminder to Altantuya not to disturb Abdul Razak at home.
Before giving her testimony, Rohaniza asked the judge's permission to refer to the notes on the conversation between Azilah and the Chinese woman that she had jotted down several days after she was released from detention on
Noreen, however, asked Rohaniza to recall what had transpired without referring to the notes.
Subsequently, Rohaniza said that during the journey, the Chinese woman asked who they (Azilah and Rohaniza) were and Azilah replied (in English) "the police".
Then the Vitara car gave a signal and stopped (beside the road).
"Azilah stopped the car. He got out of the car and walked towards the Vitara car. Azilah boarded the Vitara briefly and then came back to the (Wira) car. At that particular moment, I moved over to the front seat.
"The Chinese woman was still sitting in the back seat," Rohaniza said.
Rohaniza ended her testimony and the hearing was adjourned to Monday (July 2).

SHAH ALAM (June 29, 2007): Burmaa Oyunchimeg today lodged a police report against lawyer Hazman Ahmad for alleging that she had been coached by lawyer Karpal Singh in the Altantuya murder hearing.
Burmaa, a cousin of Mongolian Russian interpreter Altantuya Shaariibuu, lodged the report with the Shah Alam court complex police base.
The accusation arose after Karpal Singh, who earlier argued with lead Deputy Public Prosecutor Tun Abdul Majid Tun Hamzah, asked Hazman to withdraw his allegation or face the consequences.
Hazman, who represents C/Insp Azilah Hadri, made the allegations after he objected to Karpal's move to cross examine Burmaa in relation to her testimony over who the government officials were in the picture which Altantuya and Abdul Razak were seen having a meal with.
Karpal is engaged to hold a watching brief for Alatantuya's family and the Mongolian government.

Speaking loudly and clutching the placards, Nooraza condemned the violence against women and Altantuya's death.
Claiming to be an anti-war activist who had been crusading against war and violence, especially against women, Nooraza, clad in a headscarf and baju kebaya, vented her anger over Altantuya's killing.
"Look at how Altantuya was mercilessly murdered and some people are going around claiming they are proud ... What are they proud about?" she asked.
While talking she exchanged placards, placing the ones she held earlier and picking up others which she placed earlier on the ground.
Police personnel on duty just watched and recorded her movements while she went on with her protest for about 40 minutes.
She then told reporters she was disturbed over Altantuya's murder and the way she died.

Azilah Told Altantuya Not To Disturb Razak
SHAH ALAM, June 29 (Bernama) -- The Shah Alam High Court here was told Friday that Mongolian woman Altantuya Shaaribuu had been reminded by Chief Inspector Azilah Hadri not to disturb Abdul Razak Abdullah Baginda and create a commotion in front of the political analyst's house. Azilah's girlfriend, Lance Corporal Rohaniza Roslan told the court that Azilah also instructed Altantuya to meet Abdul Razak at his office if there was any problem. She said Azilah also told Altantuya not to disturb Abdul Razak because he had a family. Rohaniza said this when testifying as the seventh prosecution witness in the Altantuya murder trial which entered its 10th day today.
